Hereinafter any and all references to Furniture in Parts Corp., Door Store or doorstorefurniture.com refer to the same business entity.

General

This site is provided as a service to doorstorefurniture.com customers. Following are the rules that govern the use of this site. Your use of this site constitutes your agreement to be bound by said rules. If you are in disagreement with any of the rules contained herein, please refrain from using the site. doorstorefurniture.com will periodically change the site and rules at its discretion. All changes are effective immediately upon posting. You may check periodically to see if this agreement has changed. The only notice of said changes will be evidenced by the last updated date at the top of the page.

Agreement

Our website is an invitation for you the consumer, to make doorstorefurniture.com an offer to buy an item or items found on our site. When you submit an order it constitutes an offer, which we only accept by shipping the items ordered. When submitting an order, an automated order confirmation e-mail is generated. This does not constitute an acceptance by us of your offer. We may at our discretion prior to shipment reject your offer to purchase due to inventory inaccuracies, unavailability, and discontinuation by us, discontinuation by the vendor, errors, or for any other reason.

Products

doorstorefurniture.com may at times not carry every item that you would find in one of our retail stores. Certain items will not be sold through our website and can only be purchased at one of our retail locations. In some cases items may be sold through our website that will not be available through our retail stores. doorstorefurniture.com may also have different pricing and or promotional events on our website which differ from the pricing at our retail locations and / or our catalog.

Color, Finish and Grain

doorstorefurniture.com makes every effort to display the colors, finish and grain of its products as accurately as possible. The actual colors you see depend on your monitor and we can not guarantee the accuracy of your monitors display. Color & grain variations are natural characteristics of fine woods and contribute to the unique individuality of each piece. For this reason we cannot assure the exact matching of related pieces. We cannot exchange merchandise for color or grain variations. Knots in wood are inherent in certain pieces and we will not make exchanges for that reason. Oxidation is a natural process affecting some woods & wood finishes. Your delivered merchandise may be lighter than the one displayed on our website or the showroom floor until it oxidizes.

Sizes

You, the customer, are responsible for knowing whether the furniture you have purchased will fit through all elevators, stairwells, corridors & doorways, around all corners, turns & bends in the building where the delivery is to take place. On oversized items, your sales associate (if purchased at one of our store locations) will have you sign a waiver guaranteeing that a specific item will fit. If purchased online all oversize items will ask you to electronically sign a waiver at check out. If a national delivery item is returned for a no fit, the customer is responsible, for the original delivery fee and a 15% restocking fee and a return freight fee. As is normal with furniture, there may be slight variations from sizes listed. Delivery to a building without an elevator requires a $10 per piece walk-up fee for each flight above the 2nd floor. For local deliveries, if upon delivery, “stock” or “regular merchandise” does not fit, the customer will be responsible for the original delivery fee and a 15% restocking fee. A store credit will be issued for the remainder. If “special order”, “final sale”, “close out”, “as is”, or “clearance” merchandise does not fit, the customer will be responsible for the delivery fee, a 30% restocking fee and a store credit will be issued for the remainder.

Errors

At all times doorstorefurniture.com will try to give accurate and reliable information on its website. However there may be times due to typographical or other errors, that the information on the website may be inaccurate or incomplete. This includes but is not limited to, pricing, colors and or dimensions. These inaccuracies are unintentional and we apologize if your order is affected in any way, but we reserve the right to amend those errors and to be able to update product information at any time without prior notice. We also reserve the right to refuse and or cancel any order placed for products, where there has been a pricing error, whether or not your order has been confirmed and your credit card charged. In the event your credit card was undercharged, doorstorefurniture.com will try and contact you, to charge you the difference. If you do not agree to pay the difference, we reserve the right to cancel the order and issue a credit to your credit card in the amount of the incorrect price. doorstorefurniture.com is not responsible for mathematical errors made on a sales invoice. doorstorefurniture.com is not responsible for incorrect price quotes made on a sales quote. If an error is discovered, you will be notified and the correct amount will be charged and/or billed. Please review your invoice for accuracy.

Pick ups

Internet orders can only be picked up at our Secaucus, New Jersey location. These internet customers must bring the receipt printed when placing their order plus the credit card used to order the merchandise and a photo ID. If purchase was made at one of our store locations the customer must present the gold “customer copy” of their sales invoice when picking up merchandise at any Door Store location. Merchandise will not be released to a customer who does not present either the gold “customer copy “or the internet receipt with the credit card used to order and a photo ID. The customer assumes responsibility for all picked up merchandise and no exchanges, refunds or cancellations will be accepted once merchandise is taken. Customers who pick up merchandise waive all delivery options for guarantee claims. Customers should inspect all merchandise that is being picked up prior to taking possession.



There is NO WARRANTY on merchandise that is picked up from the store. Merchandise must be inspected upon pick-up for any defects or damage. Please refer to the back of your sales invoice for more information. You are responsible for the furniture once you take possession of it. No returns are accepted on any merchandise after it has been picked up from the store as they are FINAL SALE. No exchanges, refunds or cancellations will be accepted once merchandise is taken. You are responsible for transporting the merchandise to your home. Please have your vehicle clear when you come to pick up the merchandise. Door Store is not responsible for any damages that occur during transport. This includes cases where the merchandise needs to be removed from its packing to ease fitting it into your vehicle. Any means by which you transport your merchandise is your responsibility (i.e tying down trunk doors, tying pieces to the roof of a car, etc …)

Shipping and Delivery

doorstorefurniture.com delivers everywhere in the 48 contiguous US states. doorstorefurniture.com uses several methods for shipping and delivery. The method and pricing for your individual delivery varies and is contingent on the size of your items, weight and distance from our distribution center. To quickly determine your shipping cost, follow these three steps:

1. Add the items you are interested in purchasing to your shopping cart.

2. After the items have been added to your cart, select "your cart".

3. Enter the ZIP Code where the order is to be shipped and then click "calculate".

The website will calculate the freight cost based on the total weight of the items in your shopping cart and your location.

As follows is a brief explanation of our distinct delivery methods:

Local delivery – Consists of deliveries up to 75 miles from Columbus Circle, NYC. These deliveries will be performed using our local delivery drivers. If you live within this area and purchase in stock merchandise on doorstorefurniture.com you will get a call on the next business day to schedule your delivery. You will then get a confirmation call 24 to 48 hours prior to your delivery. Our local delivery service is a complete delivery service, meaning we will deliver inside, remove the packaging and if ordered and paid for by customer, assemble. You may call 201-864-6669 during or regular business hours (9:00 am to 6:00 pm Monday thru Saturday) and speak with a customer service representative or our dispatch department. Note: follow the prompts to direct you to the appropriate department.

UPS – For those items small enough to ship via UPS we will do so. UPS will only drop off at your door and will not unpack or assemble any of your items

National delivery - Orders shipped outside of the local delivery area that are too large for UPS will be shipped via freight carrier. Freight carriers differ from UPS in two main respects. First, the freight carrier contacts you via telephone in order to schedule a delivery appointment. Typically deliveries are scheduled during regular business hours: Monday through Friday, between 8:00 am and 5:00 pm. Secondly, our National freight carrier is a complete white glove service, meaning they will deliver inside, remove the packaging and assemble. National deliveries can take anywhere from 2 to 6 weeks for delivery from the time the merchandise is in stock in our distribution center and all balances are paid in full.

General delivery info – If someone other than yourself is accepting the delivery, they are acting as your agent and therefore their signature will be binding. If your merchandise is not available for immediate delivery, i.e. special order merchandise or out of stock merchandise, and you are not given a confirmed delivery date at the time of purchase, an estimated date of arrival will be indicated on the sales invoice. In this instance, the delivery department will contact you by telephone when your merchandise arrives to schedule your delivery or to advise you, we will be releasing your merchandise to the freight company. In either case, you will receive confirmation of your delivery date the day before delivery. doorstorefurniture.com cannot specify a delivery time. Our normal delivery hours are 7:00am to 7:00pm. Occasionally, extenuating circumstances occur and your delivery may be delayed. If so, you will be notified by our customer service department. There is a redelivery charge if you are not home on the scheduled day. We cannot accept postponements of scheduled delivery dates unless we are notified 48 hours prior to the scheduled delivery date. Assembly, packing, shipping, walk-up and delivery charges are non-refundable once services have been rendered or attempted. It is the customer’s responsibility to notify doorstorefurniture.com at the time of purchase of any building restrictions and if a Certificate of Insurance is required. Approximate delivery date quotes for out of stock or special order merchandise may vary due to vendor delays. doorstorefurniture.com is not responsible for vendor delays and compensation is not available. If at the time of your delivery the merchandise has to be walked up more than one flight of stairs (as a result of merchandise not fitting into the elevator or unavailable elevator) customer service must be notified to arrange a walk-up fee. The delivery personnel have the right to refuse any walk-up without advance notice. If this occurs your delivery will be scheduled for another day. At times doorstorefurniture.com uses independent contractors for delivery services. In the event damages occur to your premises doorstorefurniture.com will assist in obtaining a resolution with the independent contractor by providing contact information to the customer and the independent contractor.

Return policy

If you are in our local delivery area, you may refuse and return damaged merchandise discovered during delivery. (Local delivery is 75 mile radius of Columbus Circle, NYC) At the time of delivery, customers have the opportunity to inspect merchandise for any damages. Any defect must be notated in detail by the customer on the driver’s delivery manifest. Merchandise received & signed for in good condition may not be returned or cancelled. It is requested that the customer call our customer service department on the day of delivery to report any claim/problem. We reserve the right to determine if and when an item(s) will be repaired or replaced.

If you received your merchandise via our regional or national delivery programs, and any merchandise is damaged, you must notate on your delivery receipt the nature of the damage. You then must call our customer service department within 48 hours and we will assist you in making a claim against the carrier.

If you refuse your delivery without inspection, miss your delivery appointment(s) or return a non-defective or undamaged product, you will incur original shipping charges along with actual return shipping fees. There will also be a 15% restocking fee for stock merchandise if a return is processed and a store credit, less applicable charges, will be issued. All returns are inspected upon arrival at our warehouse. Items not in their original, new, unopened condition may qualify for only a partial refund of the product’s price. By purchasing at doorstorefurniture.com you authorize doorstorefurniture.com and/or its Carriers to assess additional fees to your credit card as necessary according to the fee schedule described here. We may deduct a 15% restocking fee, original and return shipping costs from your refund or otherwise charge them to your credit card after the product is returned.

Guarantee

We guarantee our merchandise against damage arising from structural defects for one year and reserve the right to determine the cause of any damage. Should any such defect appear during this period, doorstorefurniture.com will repair or replace the item or part, at our option, upon inspection at our local warehouse or by our local delivery staff. This guarantee applies to regular merchandise only, delivered to our local delivery area (see explanation of local delivery area above), and does not cover marked down merchandise, “as is” merchandise, “close out”, “discontinued” or “final sale” items, upholstery fabrics, leather, rattan, glass items and all accessories are specifically exempt. doorstorefurniture.com cannot guarantee them as to color fastness, wearing qualities and breakage. All merchandise treated with Master Seal protection includes a separate Master Seal warranty (refer to your Master Seal warranty for specific information). Mattresses and box springs carry their own warranty (refer to the warranty included with your mattress and box spring for specific information). As a result of use, cushions on upholstered merchandise may differ in firmness than on the showroom floor. Accessories are considered “final sale” and no exchanges will be made. doorstorefurniture.com is not responsible for shade variations between sample fabric or leather swatches and the doorstorefurniture.com finished product. We are unable to specify weight limits on any shelving. We will not assume responsibility for damage to doorstorefurniture.com merchandise or damage to any personal items caused by collapsed shelves. The doorstorefurniture.com guarantee is null and void if merchandise is not assembled by an authorized doorstorefurniture.com technician. Merchandise used for commercial purposes forfeits the guarantee. All guarantees are null and void if furniture is moved from original address. Customer is responsible for keeping their internet receipt or their gold “customer copy” of the invoice, which includes their sales receipt number that must be utilized for the one-year warranty offered by doorstorefurniture.com to our local delivery customers. Upholstery & other merchandise that have been disassembled or altered in any way are exempt from the warranty. Merchandise ordered from “IFS”, “DaRush” and “Sharut” are delivered & serviced by their own customer service departments and customers are responsible for contacting them directly for all customer service issues (customers will be given their appropriate phone numbers upon purchase). National deliveries are excluded from the 1 year warranty.

Payments

Orders placed for merchandise that is in stock, “pick up” orders, or orders requiring assembly must be paid in full at the time of purchase. Special order and out of stock merchandise require a non refundable (after 48 hours) deposit of one half of the total order. Special orders and out of stock merchandise may be cancelled within 48 hours for a full refund, after that time these orders are non cancellable. These orders must be paid in full upon scheduling a delivery date or before a pick up is made. We do not accept C.O.D’s. If an error occurs and a delivery is made without balance(s) being collected, it is company policy to automatically charge or bill the customer, and the customer is responsible for making immediate payment regardless of when delivery was made. A $30 fee will be charged for any check returned for non-sufficient funds or stop payment.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If you are concerned about how your information is used, you should check back at our web site periodically.

Upon request, and after using appropriate identification measures, we provide site visitors with access to unique identifier information (e.g., customer number or password) that we maintain about them, transaction information (e.g., dates on which customers made purchases, amounts and types of purchases) that we maintain about them, contact information (e.g., name, address, phone number) that we maintain about them.

Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods. You agree to exclusive jurisdiction by the federal and state courts located in New York, New York, U.S.A., and waive any jurisdictional, venue or inconvenient forum objections to such courts.
